The Nigerian High Commission has called for justice for a Nigerian national who was allegedly gang raped on June 4.
It is appealing to Malaysian authorities to prosecute the case before dealing with the 30-year-old woman’s immigration status.
She is under investigation over the validity of her visa
and is currently detained.
A spokesman for the high commission told FMT the alleged
rape had left her with physical and psychological injuries.
“There is a need for reparation and punishment for the injustice,”
he said.
Four men have been arrested in connection with the
alleged rape and Kuala Lumpur police said they were looking for three other
suspects.
The embassy spokesman said a consular officer had visited
the police station handling the case and had spoken to the woman and the
investigating officer.
He said it was possible that she was a victim of human
trafficking or some other form of transnational organised crime.
The high commission was collecting information about the
case and would submit a note verbale to Malaysia’s ministry of foreign affairs,
he said.
“We intend to do that by the end of the week,” the
spokesman added.
Earlier this month, a 30 year old Nigerian woman by the name of Nicole was allegedly gang-raped by some Chinese guys and she is to be arraign in court for not having a visa by trying to cover the rape meted on her.Nicole met with the Chinese guy at Changkat, Kuala Lumpur.
At the hotel, the guy had arranged for some of his friends to be at the premises. Nicole claimed she was beaten and forcefully gang raped. They then took her to another location where a new set of friends raped her again, two people at the same time without using any protection.
They had also taken photos and videos of Nicole being naked and threatened that they will post in on Facebook if she discloses this issue. Nicole pleaded then not to do so and she was held hostage after several hours of rape. At that point, she started shouting loud for help. A girl in that house opened the door and told her to run away. Nicole ran out and informed the security guard and told him to call the police because she was beaten and raped.
After reporting, the police arrested the four Chinese guys and locked them up for five days. Later, they were released on bail because the father of one of the Chinese boys is an influential person and owns lots of hotels in Malaysia.
Nicole however, was remanded for not having a valid visa.
Rape. According the the Malaysian
Penal Code, it is defined as sexual intercourse with a women against her will
or without her consent. Sexual intercourse with a woman is also rape when:her consent is obtained by putting her in fear of death or
hurt;when she unable to understand the nature and consequences of
what she is consenting to;or when her consent is obtained by using a position
of authority, a professional relationship, or other relationship of trust.According
to the Penal Code Section 376,
Besides
that, punishment with imprisonment for a term up between 10 to 30 years along
with whipping can be imposed on those who committed rape under these
circumstances:

causes hurt to the woman or another person

In addition to the offence,
puts the woman in fear of death or hurt to herself or any other person
·
Commit rape in the presence of
another person
·
Rape a girl under 16 years of
age without her consent
·
Rape a girl under 12 years of
age, with or without her consent (statutory rape)
·
Commit rape with a woman’s
consent with the use of authority over her due to a relationship of trust
or a professional relationship
·
Rape a pregnant woman
·
The woman becomes insane due to
rape
·
When the rapist is aware of his
condition of having HIV/AIDS or any sexually transmissible disease
·
The woman commits suicide due
to rape
·
When the rapist is aware of the
woman’s mental disability, emotional disorder, or physical handicap
·
Imprisonment for a term
between 15 to 30 years with whipping of no less than 10 strokes can be imposed
on the rapist who causes the death of the woman.

Sad to say, not just in Malaysia but in other parts of the world, victims of rape are left without justice.They suffer the consequences while the rapist roam freely, preying on the next victims. Is it just that with having all the money and by being rich, you get away with almost everything? From the case above, the four Chinese guys were initially charged under Section 334 of the Penal Code for voluntarily causing hurt. However Nicole's lawyer urged that the men be charged under Section 376 for rape. Being charged for voluntarily causing hurt, the imprisonment for a term is extended for a year and a fine of RM2000 only. For someone who's father owns hotels and is filthy rich, this is a piece of cake. Rapist should be left in imprisonment for a longer term and they should be punished severely so that the next time they think about raping someone, they would remember the pain and agony they went through. Its not that I'm being inhuman but they need to learn moral. So many rapist are at loose. They fear nothing. They don't care about their victim as long as they fulfill their selfish and lustful desire.Their victim vary from women to teenagers and even children. Don't you think something has to be done to curb this issue?
It may never occur to you but
think for a moment, if the similar case happened to someone you know; your
sister, female friend. Would you still let in slide away in silence? I'm not
saying you should fight and create a scene about it but let your voices be
heard. Women are delicate being. It is through them that the source of life
began. We should be gifted to have such beings in our lives. If we don't
protect them, who else will? I think that the police should deal with the rape
case first and then look into the issue of not having a valid visa.

And to the authorities, I hope you won't take this issue lightly because compared to physical and mental injuries, mental injuries can be fatal and can lead to far worse consequences.
